Leasing Information

Bellsmith Regency has strict leasing regulations.

Homeowner Management Services is partnered with Rental Monitoring Solutions to effectively manage the leasing activity in Bellsmith Regency Townhome Association. 

If your property is leased, you must receive a leasing permit from Rental Monitoring Solutions (RMS): www.rmsassist.com. The lessor is fully responsible for the actions, activities, and/or noncompliance of their lessees.

Short-Term Leasing/Transient Use: The Association prohibits the use of any Townhome for short-term or transient leases or rentals, including, but not limited to, those arranged through websites like Airbnb or VRBO. Pursuant to Article VII, Section 6 of the Declaration, as amended, any lease for a Townhomes must have a minimum lease term of 1-year, which restriction prevents shorter term leases and rentals of the type described herein. Please note that any violation of this provision shall be subject to fines and other penalties as authorized under the Declaration and Georgia law.

Leasing Requirements

  • All owners must apply for and be granted a permit prior to leasing their home. 

  • Units must be one year owner occupied prior to being considered for a permit. 

  • Leases must have an initial term of at least one year. 

  • Short term rentals, such as Airbnb or VRBO, are not permitted.

  • Permits are automatically revoked upon sale of a lot or owner moving back into the unit

  • Rent, or a portion thereof, can be assignable in certain circumstances if the owner is past due on assessments.

  • The owner transfers their right to use the recreational facilities to the tenant when the home is leased. 

  • Owners are responsible for providing gate access to their tenants. 

  • Annual leasing administration fee applies.

  • Owners are required to submit a copy of the lease agreement and their tenant’s contact information to the association

  • Owners are responsible for their tenant’s behavior at all times

  • Notification Requirements:

    • Within 10 days of new lease the owner must provide:

      • A Copy of the Lease

      • Name of Lessee

      • Phone number of Lessee

      • Owners Address and Phone Number

      • Other items as Board deems reasonable
